A lawsuit has been filed by the children of former Cincinatti Bengals wide receiver, Chris Henry, for the wrongful death of their father in an accident caused by their mother. The suit states that the mother was negligent when she drove recklessly so that it threw Henry from the bed of the pick-up truck and he died from his injuries. The mother and Henry had had an argument at her home, and she sped away in her pick-up truck. Henry jumped into the bed of the pick-up and pounded on the window so that she would stop. The mother continued to drive recklessly and Henry was thrown onto the pavement. The family stated that they were not trying to get money from the mother, but instead were looking for money for loss of support for the kids from the insurance company of the mother and under Henry’s underinsured motorists’ coverage.

Woman Who Suffered Traumatic Brain Injuries Awarded $7 Million Settlement

In a recent case a New York woman received a $7 million settlement from the City of Buffalo when she received traumatic brain injuries after being rescued from drowning by her son at a City run swimming pool. It was alleged that the City was negligent in failing to supervise and adequately train its lifeguards. The woman alleged that although the pool was very crowded the lifeguards were in attentive and were socializing and text messaging on their phones rather than properly guarding the safety of the public. Construction Worker Hit by Drunk Driver Finalizes Settlement

A Pennsylvania construction worker who was hit and rendered a paraplegic by a drunk driver settled his case for $70 million on December 13th. Bad News for Personal Injury Victims

Recently, a very bad case for accident victims was decided by the California Supreme Court. As background, if a decision is made by the California Supreme court, that decision becomes law immediately unless someone appeals the decision to the United States Supreme Court. The case is called the Howell case.

That decision said that if an insurance company paid a hospital a discounted amount for the patient’s medical care that when suing, the injured person can only get the discounted amount that the medical insurance paid. The Court reasoned that since the injured person can only be made to pay back the amount to the insurance company that it paid that the injured person should not get a windfall.

Exactly what this case means is unclear. We don’t know whether if the case goes to trial whether the jury will be told that the cost of the medical care was only the discounted amount. If so, that would be bad because the jury often awards pain and suffering damages based on the amount of the medical bills.

A personal injury lawsuit has been filed against the WWE by a man named Shane Hawley who claims negligence resulting on a metal object falling 40-50 feet and injuring him.

He is claiming that he suffered personal injuries, physical and mental pain for suffering, costs of medical care, loss of income, loss of earning capacity and other damages.

Judge Impeachment Results in Upheld Appeal

An appeals court has sided with plaintiffs claiming a biased judge who was removed from the bench by Congress wrongfully dismissed their personal-injury lawsuit.

It was ruled that US District Judge Thomas Porteous was significantly influenced by the close relationship he shared with one of the defendent’s attorneys.

Porteous was impeached over allegations that he accepted bribes from individuals with business before his court.

In 2004 he dismissed claims over injuries sustained from a boating accident blamed on the wake from a passing yacht. However, he was also a friend of the lawyer for the owner of the yacht.

The plaintiffs won an appeal to revive the appeals case with a new judge.

Exercise Manufacturer Personal Injury Settlement

Exercise manufacturer Cybex International of Medway, Massachusetts is seeking a reduction in damages paid out in a recent personal injury lawsuit.

The firm has already managed to have the settlement reduced by $21 million but is hoping to trim it even further.

The suit concerns Natalie Barnhard, a physical trainer who was crushed and left a quadriplegic when a weight machine manufactured by Cybex fell on her while she was using it to do a shoulder stretch.
