Settlement Reached in Wrongful Death Case

The husband of a woman who died in 2008 after a fatal bicycle accident reached a settlement with the city of Medino Park, after his wife fell from her bike when she struck a broken piece of a traffic cone. Although a broken piece of a traffic cone may or may not be preventable, according to the wrongful death lawsuit, the orange traffic cone should never have been placed near a bicycle path in the first place. According to the federal Manual of Uniform Traffic Control Devices, used by road managers nationwide, “posts or raised pavement markers should not be used to separate bicycle lanes from adjacent travel lanes.” The husband did not disclose the amount of the settlement, and now spends his time educating others on the importance of adhering to traffic safety codes and procedures.
