Woman Receives Multimillion Dollar Settlement in Birth Injury Lawsuit

An Illinois woman received a $9.5 million dollar settlement after suing a hospital, doctor and midwife for medical malpractice, alleging they were responsible for causing her son’s cerebral palsy.

The plaintiff’s lawsuit accused the defendants of negligence for failing to provide a doctor during her son’s birth, and allowing the midwife to perform the delivery alone. During the birth the infant suffered from a lack of oxygen to the brain for nearly fifteen minutes when the umbilical cord became compressed, resulting in the development of cerebral palsy. According to the lawsuit, the midwife chose to perform a risky procedure to correct the birth complications rather than seek help.

Unfortunately, these stores occur far too often during childbirth procedures. Cerebral Palsy causes permanent disabilities, and its victims require a lifetime of special care.
