Lawsuit Filed Against Construction Company for Failure to Warn Drivers of Construction Zone

A lawsuit was filed earlier this month by Timothy Balota, for injuries sustained after a multi-car collision occurring in an construction zone. According to his complaint, a chain reaction collision occurred when a driver two cars behind Mr. Balota failed to slow down, and struck a semi-tractor trailer idling behind the plaintiff. After being hit, the trailer rammed into Mr. Balota, causing him physical injuries.

Listed as a defendant in the lawsuit is the construction company conducting a reduced-speed zone where the plaintiff came to a slowdown and then stop. The plaintiff argues the construction company failed to have a flagman present at the speed zone, and that a flag man would have been able to adequately direct and control oncoming traffic in the construction zone. In addition, the plaintiff argues there was inadequate warnings for drivers to reduce speed when entering the construction zone.
